Labour Inspectorate found offense in tilt-workers in DNB – NRK

While it was quiet summer in Oslo Labour Inspectorate conducted inspections at both DNB and in the Indian subcontractor Tata Consultancy Services, TCS.

In July trooped Labour Inspection inspectors into DNB’s premises. At a large bank headquartered Authority has interviewed Indian IT workers that are associated with prestige project lashes.

The Authority has also conducted interviews with DNB’s management.

NRK told a few months ago that LO -forbundet EL and IT had received tips about illegal employment related to work with DNB lashes project. Trade union referred it to the Labour Inspectorate.

Both DNB and Tata has repeatedly emphasized to NRK that they follow Norwegian law.

Now available the first conclusions from Labour’s investigation of tilting project.

NRK has gained access to reports showing that Labour Inspection has found several violations the working Environment Act for tilt arbeidserme working in DNB’s premises.

– As long as the process is ongoing and we will not comment on the individual points. We are immersed in a tilsynssprosess and cooperates with the Norwegian Labour Inspection Authority, says Vikramjit Grewal.

This is the offenses

Arbeidstilsynet writes:

“There is a breach of:

  • limit overtime, cf. working Environment Act § 10-6, fourth paragraph
  • limit for how much an employee may work during the eight weeks, cf. working Environment Act §§ 10-5, second sentence and 10-6 eighth paragraph
  • the requirement for weekly off-duty period of 35 hours during the seven days jff.arbeidsmiljøloven § 10-8 second paragraph. “

Labour Inspectorate also responds that the Indian iT workers work at night and weekends without present good enough reason for it.

They write: “There is a high degree of probability violating the ban on working on sø.- and public holidays, cf. working Environment Act § 10-10, second paragraph.”

Arbeidstilsynet writes that there are indications that the system of working in Tata hinder employees to register the time they actually worked. Contingency guards are not compensated.

TCS has assured Labour Inspectorate that they will introduce a new time accounting system next year and that the HR department their will attend courses better in Norwegian rules.

– We take this seriously and this has our full attention. We are in the middle of implementing measures, including means training our leaders, says CEO Vikramjit Grewal Tata Consulency Services Norway.

DNB can not check

Arbeidstilsynet also examines DNB’s responsibility in detecting offenses that take place in the bank’s headquarters, but the work is not done.



– we have initiated their audits of corporate responsibility subcontractor TCS, says Even Westerveld DNB.

– report of Labour Inspection shows that certain officers at our subcontractors have been working too much and too many days in a row. There are, of course we are not satisfied with. But the agency has not been able to find examples of the scope NRK described earlier in the summer, says Even Westerveld, communications director at DNB.

Arbeidstilsynet wonders why DNB says they do not have the opportunity to use the access control system to control when the Indian IT workers depart and arrive at work.

– It’s not that simple, says Westerveld. He says several of the outputs does not detect when people actually go in and out. DNB Nor has supplied information about when IT workers actually signed DNB’s computer systems.

Labour Inspectorate will to NRK declined to comment, but refers to the letters we got access to. Labour Inspectorate should have more meetings and supervision of Tata and DNB and have not concluded how they will react to the offenses and does not rule out several illegalities. Also claims fear culture to be investigated.

Disturbing

EL and IT associated who reviewed the matter is not surprised.



– we are not surprised offenses, said Jan Olav Andersen, manager of the El and IT related. There were trade union who first alerted Arbeidstilsynet their suspicions.

– the combination of these severe violations of most of the Norwegian labor regulations, says union leader Jan Ove Andersen El and iT Association.

Andersen says he now expects Norwegian companies using TCS thinking good about.

– it is disturbing that the major Norwegian companies have used this company apparently surprised that the noncompliance has occurred, says Andersen.
